The Director of Compliance oversees compliance within our organization by ensuring that financial and operational procedures, including all personnel, function in compliance with applicable laws, regulatory requirements, policies, and procedures.
As the compliance leader and subject matter expert, the Director of Compliance is accountable for establishing standards and implementing procedures to ensure that compliance programs throughout the organization are effective and efficient in identifying, preventing, detecting, and correcting noncompliance with applicable laws and regulations. Additionally, the Director of Compliance is responsible for developing and improving the organization's policies and standards to outline ethical, safe, and efficient procedures. The Director of Compliance is responsible for the effective management of an organization's compliance programs and promoting a culture of integrity and ethical decision-making throughout the organization.
The Director of Compliance reports directly to the Chief Executive Officer. The Director of Compliance must also inform the Board of Directors and senior management about compliance issues and material violations, provide assurance that efficient policies and procedures are in place that are understood and respected by all employees, and that the organization is complying with all state and federal regulatory requirements.
Responsibilities
- Manage and execute policies and procedures that govern the organizations' compliance programs.
- Monitor and test policies and procedures to ensure they will further compliance.
- Monitor the performance of the compliance program, including carrying out risk assessments and compliance reviews to ensure policies and procedures are being followed.
- Liaise with legal and regulatory bodies on compliance-related issues.
- Ensure that the organization complies with existing and developing federal and state laws and regulations.
- Lead the creation of the organization's compliance programs and ensure its execution and carry out regular updates to those programs.
- Establish and set the tone of compliance throughout the organization.
- Recommend the initiation of investigations into alleged violations of the law or regulations, as well as alleged violations of the organization's policies, procedures, and the Code of Conduct.
- Carry out periodic evaluation of the compliance programs and make appropriate changes and improvements.
- Create and manage the path for reporting alleged violations of the law or regulations, as well as alleged violations of the organization's policies, procedures, and the Code of Conduct, and ensure protection from retaliation.
- Preside over and direct the work of the Compliance Committee.
Requirements:
- ACAMS Certification
- A strong educational background including a relevant graduate degree. MBA or Law Degree are highly desirable.
- At least 5 years experience managing a bank or non-bank financial institution.
- Experience and knowledge of applicable regulations, laws, and rules, including the Bank Secrecy Act, AML compliance, and state money transmission laws.
- Demonstrated ability to influence and work effectively and cross-functionally within a highly-complex organization with employees at all levels and, in particular, with key stakeholders and legal and compliance professionals.
- Demonstrated ability to work with state and federal regulators on compliance-related issues, to keep appropriate records mandated by applicable financial services licenses/registrations, prepare reporting documents, and Suspicious Activity Reports as-required by law.
- Self-starter with the ability to meet or exceed deadlines, prioritize, multi-task, and maintain flexibility in fast-paced, changing environment.
- Strong problem-solving skills and the ability to confront conflict and difficult issues in a professional, assertive, and proactive manner.
- Excellent organizational, written, verbal, and presentation skills, including the ability to interpret and communicate compliance guidance internally and effectively communicate with regulators.
- Authorized to work in the United States. This position is located in the United States.
