About the Team
The global Employee Relations Team is a center of excellence within the HR Department whose purpose is to enable teams to perform at their best by addressing employee concerns and helping the organization navigate complex people issues in a way that is fair and compliant. We do this by fostering a fair, safe, and inclusive culture; serving as a thought leader for change; and building organizational capability by empowering employees, managers and leaders. We help manage high risk situations and govern processes and investigations involving involuntary terminations, employee misconduct, and requests for reasonable accommodations. Our team leverages our experience, expertise, and organizational awareness to act as a credible, trusted advisor and thought partner to HR and business leaders across the organization. About the Role
Reporting to the Director Employee Relations, the Employee Relations Investigator is part of the Employee Relations team, a division of the HR Department focused on ensuring that employees are treated fairly, with respect, and consistent with our Core Values and company policies. This position will primarily focus on conducting internal investigations into complex employment matters and allegations of employee misconduct, including discrimination, harassment (hostile work environment), retaliation, and other potential violations of company policy. The Investigator will be responsible for conducting, tracking, and leading investigations end to end, including: conducting intake and witness interviews; assessing credibility and using judgment and discretion to determine the witnesses to be interviewed; gathering and analyzing relevant documents and emails; identifying and assessing potential policy violations or legal issues; making factual findings and drawing conclusions utilizing their legal background, knowledge of law and policy, experience and professional judgment; preparing investigation updates, summaries and related documentation; making recommendations on next steps and appropriate actions; preparing clear and comprehensive written reports as requested that analyze and assess key issues; and when appropriate making credibility determinations and recommendations. The Investigator will work closely with members of Gilead’s ER and Legal Teams.
The Investigator will help ensure that ER complaints, grievances and issues are handled impartially, objectively, consistently, transparently, and in a timely fashion. The Investigator may also be tasked with providing consultation on complex employee relations issues, performance management and incident management. As necessary, the Investigator may be required to participate in depositions, court trials, and government agency hearings.
The role will:
  • Independently manage and perform all aspects of internal ER investigations from intake through close-out, in close partnership with Legal and ER Partners where appropriate.
  • Act as an integral team member of Employee Relations and provide ER support, thought partnership, and guidance to site HR colleagues and business leaders
  • Advise on matters with potential employment or reputational risk related and provide consultation and guidance to site HR and business leaders.
  • Partner with site HRBP and ER Director in identifying trends and assessing the culture morale in order to develop programs that will foster a fair safe and inclusive environment.
  • Serve as a subject matter expert on a broad range of ER issues that could be subject to investigation, including HR policies and practices and relevant state and federal employment laws.
  • In more complex situations, partner with Legal and ER Partners to assesses the level of risk involved, assist with preparation of investigation reports and provide recommendations for resolution.
  • Respond to and investigate complaints of misconduct, policy violations, and/or potentially unlawful conduct, such as allegations of discrimination, harassment, retaliation, and unfair pay practices.
To be successful, the role will require one to:
  • Demonstrate a solid working knowledge and understanding of relevant state and federal employment laws and principles, e.g. Title VII, ADEA, ADA, FMLA, FEHA, FLSA, Labor Code, etc.
  • Think critically and solve problems by applying principles, policies, and procedures to unique situations.
  • Demonstrate operational and process rigor and familiarity
  • Collaborate well with teams across functions, departments, and geographies
  • Be proficient in related technology and case management tools
  • Handle difficult conversations and sensitive employee information
  • Work collaboratively and make decisions while keeping all partners and leaders informed
  • Demonstrate the ability to work independently in a fast-paced environment and navigate unique or ambiguous situations using their best judgment.
  • Consistently exercise discretion and independent judgment in managing ER investigations and advising HR and business leaders on how to navigate sensitive ER issues in a fair, compliant, and pragmatic manner.
  • Discern what stakeholders to involve and when to consult legal and ER leader on complex matters
Qualifications & Experience
  • Excellent verbal and written communication and presentation skills, including the ability to prepare well written investigation summaries.
  • Ability to exercise sound judgment and provide strategic advice
  • Must possess solid networking and influencing skills
  • Previous HR Business Partner, employment law, or management experience a plus
  • Ability to effectively interact with employees at all levels of the Company
  • Broad knowledge of HR principles, practices, and procedures in US and California
  • Minimum of 8 years of relevant work experience with 2 years directly managing complex employee relations issues, preferably in a global biopharma company within a centralized ER model
  • Excellent teamwork and interpersonal communication skills are required
  • Effective customer support skills
  • Ability to manage a high volume of work
  • Bachelor's degree (BS/BA) required. Advanced degree desired (JD, MS/MA, MBA) and can be substituted for 2 years of experience. PHR/SPHR a plus.

The salary range for this position is: $136,000.00 - $176,000.00. Gilead considers a variety of factors when determining base compensation, including experience, qualifications, and geographic location. These considerations mean actual compensation will vary. This position may also be eligible for a discretionary annual bonus, discretionary stock-based long-term incentives (eligibility may vary based on role), paid time off, and a benefits package.
