Job Description

General Description:
The Compliance Counsel will report directly to the Senior Contracts Counsel, Applied Innovation Strategy and is a member of the Applied Innovation Team, a highly innovative and entrepreneurial team incubating platforms solving for clinical trial inefficiencies, rising costs of drug development, technological challenges in healthcare/pharma tech, and fragmented data silos. The candidate will establish, develop and oversee the function’s global healthcare, clinical research and privacy compliance programs.
Essential Functions of the job:
  • Conduct periodic risk assessments and develop and implement a work plan to address and minimize such risk.
  • Support company-wide compliance measures with regional, local and worldwide laws such as HIPAA, CCPA, GPDR, LGPD, PIPL etc.
  • Provide legal advice and support for incident managements and development of applicable response measures.
  • Prepare periodic Compliance activity reports and facilitate proactive communication and socialization of initiatives to ensure a culture of compliance of function.
  • Monitor developments in global data privacy and cyber laws (and related legislation and industry practices) and provide sound compliance advice based on up-to-date knowledge of relevant data privacy, security regulations and industry guidelines across global markets.
  • Hire and retain global compliance team and ensure appropriate and cooperative allocation of responsibilities.
  • Contribute to contract negotiations on data processing agreements, data protection and transactional matters.
  • Development of policies, procedures and guidance documents to facilitate, support and execute the company’s privacy program to enable consistent, effective data privacy practices and minimize privacy risk.
  • Advise on corporate compliance matters including interpretation of BeiGene’s Code of Business Conduct and Ethics, and Company policies, procedures and practices regarding anti-bribery and anti-corruption, contracts, confidentiality, conflicts of interest, insider trading, privacy and security and other matters.
  • Build or maintain network of global compliance professionals and stay current on new laws, rules regulations, best practices and enforcement trends
  • Lead and develop team to manage global healthcare compliance matters for multiple functions, including: interactions with healthcare professionals, patients, cyber and data protection privacy law, managed care entities, academic institutions, government entities, reimbursement, contracting and transparency.
Qualifications:
  • Comprehensive knowledge of global laws regarding kickbacks, fraud and abuse, false claims, drug development and marketing, price reporting, privacy and government contracting, transparency, privacy, bribery and corruption.
  • Excellent organizational skills and problem-solving capabilities and the ability to perform in a fast-paced, high volume, deadline-driven environment.
  • Appropriate judgment to liaise with Legal and business colleagues and/or outside counsel as needed.
  • Extensive experience with compliance matters relating to healthcare, especially healthcare IT and global privacy laws such as HIPAA, GDPR, etc.
  • Experience negotiating data protection terms in a variety of enterprise agreements based on the U.S. and E.U. privacy frameworks.
  • JD from accredited law school with demonstrated academic achievement and current bar membership in good standing.
  • Strong critical thinking skills, attention to detail, adaptability, communication skills and professionalism.
  • Exceptional and demonstrated written and verbal communication skills and interpersonal skills in both one-on-one and group settings, as well as proven negotiation skills.
  • Ability to apply a risk-based analysis to compliance issues and demonstrate creativity and flexibility in developing solutions that satisfy both business requirements and legal obligations.
  • 5+ years combined relevant experience including external or in-house experience developing global compliance programs in the biotech, pharmaceutical, or health technology industry.
Education Required: Law Degree from an accredited international institution. Deep knowledge of FDA, EU, and other global regulations and guidance governing Good Clinical Practice (GCP).

Salary Range: $180,200.00 - $230,200.00 annually

Actual compensation packages are determined by several factors that are unique to each candidate, including but not limited to job-related skills, depth of experience, certifications, relevant education or training, and specific work location. Packages may vary by location due to differences in the cost of labor. The recruiter can share more about the specific salary range for a preferred location during the hiring process. Please note that the listed range reflects the base salary or hourly range only. Non-Commercial roles are eligible to participate in the annual bonus plan, and Commercial roles are eligible to participate in an incentive compensation plan.
