Job Description

JOB SUMMARY

Provide professionally licensed expert employment and labor related legal services to one or more operating companies and departments or functions and/or performs special legal assignments of major importance. Work involves facts that are open to various interpretations, applicable precedents may not exist and the law does not relate to or regulate particular situations which may require substantial independent judgment. The matters in question usually have a significant impact on organization operations, strategies or profitability.

ESSENTIAL DUTIES AND RESPONSIBILITIES

  • Attend to case management and defense of all employment and labor-related litigation, internal review, and administrative proceedings within assigned territory including, but not limited to EEOC, DOL, OSHA, NLRA, etc...
  • Analyze litigation and charges to determine information necessary to successfully defend action.
  • Communicate with management and outside counsel to effectively defend litigation and charges.
  • Conduct internal investigations and analyze results for management or outside counsel.
  • Review and revise as appropriate all position statements prepared by outside counsel prior to submission to the United States Equal Employment Opportunity Commission, or other investigative agency.
  • Prepare or assist outside counsel in the preparation, review, and revision as appropriate of all pleadings and other court related documents.
  • Coordinate discovery responses with outside counsel and involve the necessary departments to ensure thorough and accurate information is provided consistently.
  • Attend mediations and settlement conferences and other key hearings, trials, pre-trials, depositions or meetings involving employment related litigation or charges.
  • Advise Senior Management of matters involving substantial legal exposure.
  • Maintain 3rd party record reporting system for all litigation, charges and potential litigation.
  • Provide guidance to Human Resources team on day-to-day employment related issues including investigations, leaves of absence, disciplinary actions and terminations.
  • Provide legal advice to a variety of departments (Labor, Safety, Payroll, Operations, Sales etc.) regarding employment and labor related issues.
  • Monitor and advise company personnel of any changes in laws as required.
  • Assist in the management and defense of all OSHA citations and related matters.
  • Prepare, review and update Company policies to ensure compliance with laws.
  • Advise management personnel regarding more complex cases of discipline or termination of non-union or management employees.
  • Prepare and review proposed contracts, leases, formal agreements, and other legal instruments to safeguard the Company’s interests.
  • Partner with the leave administration and ADA teams to provide guidance with regard to leave and accommodation requests including processes, laws and applicable Company policies.
  • Provide training to managers and employees, as needed, on key employment laws.
  • Other special projects or provide legal advice in other areas of the law as needed.

MINIMUM REQUIREMENTS

  • Legal degree from an ABA accredited law school and a current license to practice law.
  • At least eight (8) years of related legal experience; at least five (5) years of litigation experience including employment litigation. At least five (5) years of law firm experience required.
  • Ability to exercise independent judgment and to handle confidential and proprietary information using excellent discretion and judgment.
  • Strong communication, organizational and decision making skills.
  • Travel 25-35% of time.

PREFERRED QUALIFICATIONS

  • Law firm and in-house legal experience preferred including at least two (2) years of related legal experience in an in-house legal department.
  • Previous experience working on complex, multiparty litigation including case management, development of appropriate litigation strategy and case resolution including mediation and trial.
  • Previous experience managing a docket of cases from inception to resolution.
  • Previous experience working in or with organizations who have negotiated collective bargaining agreements.
  • Previous experience developing and implementing processes and procedures to assist with case and claim management.
  • Previous experience working with and managing legal support staff such as administrative assistants and paralegals.

WORKING CONDITIONS

This job operates in a professional office environment indoors. Routinely uses standard office equipment such as computers, phones, photocopiers, filing cabinets, and fax machines.

PHYSICAL DEMANDS

The position requires the ability to spend long hours sitting or standing while using office equipment and computers. Ability to perform repetitive tasks such as typing and keying. Occasional lifting, pushing/pulling, carrying 10 lbs of supplies and materials is required.
