Provisional appointment:
Either 1: a bachelor's degree (or higher) in a paralegal/legal assistant program from a regionally accredited college or university, or college or university accredited by the Accrediting Council for Independent Colleges and Schools (ACICS) or one approved by the American Bar Association (ABA); AND one year of subsequent full-time experience as a Paralegal/Legal Assistant (see definition below).
Or 2: an associate's degree (or higher) in a paralegal/legal assistant program OR a certificate in a paralegal/legal assistant program where either the degree or certificate was granted from a regionally accredited college or university accredited by the Accrediting Council for Independent Colleges and Schools (ACICS) or one approved by the American Bar Association (ABA) AND two years of subsequent full-time experience as a Paralegal/Legal Assistant (see definition below).
Definition: For the purposes of this examination, a Paralegal/Legal Assistant is someone who applies knowledge of the law and legal procedures in rendering direct assistance to lawyers, clients, and courts; prepares and interprets legal documents and forms; researches, compiles and uses information from legal materials to provide both written and verbal comments on their findings; and analyzes and handles routine procedural problems independently with minimal attorney oversight.
Substitution: Graduation from an accredited (ABA approved) law school with a degree required by New York State Bar admittance will be accepted as meeting the educational requirements for either examination.
Non-qualifying degrees: Non-qualifying degrees include but are not limited to degrees in Criminal Justice, Legal Studies, Liberal Arts, Political Science, Business Administration and Business Management.
Non-qualifying experience: Non-qualifying experience includes but is not limited to experience which is limited solely to general clerical or secretarial duties performed in a law office.
Important: Non-degree certificates of completion or diplomas awarded by a training institution or company not regionally accredited or accredited by the Accrediting Council for Independent Colleges and Schools (ACICS) or approved by the American Bar Association (ABA) are not qualifying.
Non-Competitive promotion: If the number of interested candidates is three or fewer, a competitive examination will not be held and the agency, at its discretion, may nominate a qualified employee for non-competitive promotion under Section 52.7 of the Civil Service Law. Permanent appointments may be made by applicants who meet the position’s minimum qualifications if all requirements of a non-competitive promotion are met. To be eligible for a non-competitive promotion, individuals must be an employee of the Office of the Attorney General and have at least one year of permanent competitive or 55b/c service as a Legal Assistant 1 or Legal Assistant 1 (Spanish Language).
The Claims Bureau defends the State and certain state authorities in the Court of Claims. The bureau also defends individual state officers and employees in Supreme Court in civil actions for money damages arising in tort, medical or dental malpractice, unjust conviction, and breach of contract.
Duties Include:
- Arrange for witnesses and court reporters for depositions and any related logistical requirements.
- Gather information and draft discovery responses; draft pleadings, motion papers, stipulations, proposed orders and portions of memoranda of law under attorney supervision.
- Make arrangements for procurement of expert witness services.
- Perform other duties as assigned.
- Conduct higher level legal research, including shepardizing, using LEXIS or Westlaw.
- Run reports on case management system as directed by bureau management.
- Liaise with IT and the Attorney General’s e-discovery team to create and maintain computerized databases of case information and discovery materials.
- As needed, assist with the litigation of pro se inmate claims under attorney supervision.
- Assist in maintaining the Claims Bureau library.
- As needed, oversee and maintain databases for claims where insurance is applicable; coordinate with outside counsel for appropriate follow-up.
- Provide attorneys with litigation and trial support, including, most importantly, electronic and hard-copy document and electronic discovery; arranging for document imaging or photocopying; developing expertise in the Attorney General’s e-discovery search engine; loading of documents into a searchable database and retrieval of e-documents from the database; preparation of privilege logs; and performing searches of electronic documents independently or in partnership with attorneys.
- As needed, assist with FOIL requests.
