Job Description
Position Summary
Sanofi US seeks an experienced litigation and investigations lawyer to join the North American Legal Department at its Cambridge, Massachusetts office location. Reporting to an Assistant General Counsel, the Corporate Counsel will be responsible for managing litigation, internal investigations, government inquiries and claims involving a variety of Sanofi U.S. practice areas. The position requires effective and efficient management of litigation and investigations, with an emphasis on favorable results while managing costs.
The successful candidate must have knowledge of the healthcare and pharmaceutical industries, must be an effective communicator, and have the ability to work collaboratively with colleagues in Legal and diverse functional and operational areas throughout the company (such as People & Culture, Finance, Pharm Ops., Business Development, Manufacturing & Supply, IS, etc.). The person filling this position must have the ability to analyze complex situations, develop and communicate plans of action and assist with the execution and roll-out. The role also requires providing advice and counsel on business issues and the legal implications of those issues.
Role Responsibilities
The specific Role Responsibilities of the NA Litigation & Investigations Corporate Counsel include:
  • Devise novel solutions to problems and execute.
  • Develop trust and instill confidence in senior management; advise management of significant case developments and risk areas and recommend strategy accordingly.
  • Perform other duties as requested.
  • Analyze complex situations; develop, communicate, and carry out plans of action.
  • Supervise the collection and production of documents during discovery of pending litigation and in response to subpoenas, preserving all privileges.
  • Effectively work with outside counsel to determine case strategy, spearhead discovery efforts through collaboration with the business and IS colleagues, manage outside counsel spend.
  • Lead and participate in cross-functional teams throughout the Company, including providing direction to employees in other functional areas with which there is no reporting relationship.
  • Maintain detailed knowledge of the legal and regulatory environmental and current developments in those areas, and proactively apply that knowledge to matters.
  • Demonstrate Sanofi values and commitment to compliance on a consistent basis.
  • Resolve disputes with other companies or individuals through negotiation or mediation with or without the involvement of outside counsel.
  • Support a diverse caseload, including development of action plans and communication of issues, status, case developments, and litigation risks. Case load will include handling government and internal investigations, government subpoenas, regulatory/administrative proceedings, false claims act (“qui tam”) litigation, class action litigation, and general commercial litigation
  • Conduct, manage and document privileged internal Investigations relating to potential violations of company compliance policies/SOPs or law
Management Responsibility:
  • The position does not have budgetary responsibility.
  • This position manages the performance of outside counsel.
  • The position has indirect managerial oversight of other legal professionals and must be able to lead and participate in cross-functional teams throughout the company, including providing direction to employees in other functional areas with which there is no reporting relationship.
Qualifications
Education:
  • Strong academic credentials
  • Admission to at least one State Bar
  • J.D. degree from an accredited law school
Experience:
  • Experience and expertise in conducting internal and/or government investigations preferred
  • Computer proficiency required
  • Substantial healthcare and/or pharmaceutical industry experience, including working on matters involving claims under the False Claims Act and the Anti-Kickback Statute
  • Project management experience or skills are desirable
  • Other regulatory, compliance or business experience
  • Significant experience with complex litigation and knowledge of pharmaceutical compliance environment and FDA requirements
  • Experience working independently and effectively with cross-functional groups, such as Legal, Compliance, Regulatory, Medical and Commercial while maintaining strict compliance with relevant laws, regulations and policies
  • Familiarity with e-discovery issues is preferred
  • 5+ years of litigation and/or government investigation experience working in a law firm or in-house legal department
