The Office of the State Public Defender (OSPD) Capital Racial Justice Research and Writing Fellow III (CRJRW-III Fellow) plays a vital role in OSPD’s Appellate Division. The primary objective is to aid in the preparation and litigation of motions for relief under the Racial Justice Act (RJA) in capital cases. This fellowship is an excellent opportunity for people interested in learning how law and legislation interact, and about how race, ethnicity and historical inequalities impact the criminal legal system.
Under the RJA, individuals sentenced to death can challenge their sentences based on racial bias. This can be done by demonstrating either that racial bias affected their specific case or by presenting broader empirical evidence of racial bias in the imposition of death penalty. Unlike the previous standard set by the U.S. Supreme Court in McClesky v. Kemp (1987) 481 U.S. 279 which required proof of intentional racial discrimination, the RJA allows for the consideration of disparate impact without proving racial animus.
With funding allocated in the 2023-24 budget, OSPD aims to conduct a comprehensive review of its capital cases and file motions for RJA relief in superior court. Furthermore, OSPD seeks to help others obtain relief in capital or homicide cases by providing expert guidance and support services to counsel representing individuals sentenced to death.
Responsibilities
As an OSPD CRJRW III Fellow, incumbent will provide legal expertise to OSPD’s teams litigating RJA issues and collaborate with OSPD’s research staff in requesting and monitoring data. In addition, the incumbent will facilitate meetings with OSPD clients to discuss litigation progress and work with experts, investigators, witnesses, and other stakeholders to prepare the claims.
This role involves in-depth legal research, collaboration with various OSPD teams, and active participation in RJA advocacy initiatives.
Qualifications
- Ability to work collaboratively with attorneys, investigators, and social science experts.
- A record of working with underserved and marginalized communities.
- Ability to work efficiently and effectively under pressure.
- Excellent verbal, interpersonal, and writing skills.
- Strong background in California criminal law.
- Deep commitment to working towards anti-racism and to improving the outcomes in the criminal legal system for marginalized groups.
- Experience working with clients, crime victims, attorneys, and judges.
- A record of cultural humility, empathy, and cross-cultural communication skills.
- Experience with or commitment to developing a strong understanding of the California Racial Justice Act.
