Marijuana Enforcement Division

The Marijuana Enforcement Division (MED) is a dynamic and innovative regulatory agency tasked with licensing and regulating the commercial Medical and Retail Marijuana industries in Colorado. First formed in 2010 as the Medical Marijuana Enforcement Division, the MED has developed a leading-edge approach to commercial marijuana regulation and is considered a global regulatory and industry leader. The Division implements legislation, develops regulations, conducts regulatory and criminal investigations, issues business licenses, engages in outreach and education initiatives, and enforces compliance mandates using a range of intervention strategies necessary to maintain a progressive and robust regulatory framework. The MED promotes transparency and innovation by utilizing a collaborative approach to engaging with stakeholders and by proactively and positively pursuing solutions to issues in a fast-paced professional environment.

Job Duties:
This position will provide day-to-day support to the Policy & Regulatory Affairs Unit and will report to the Deputy Director of Policy & Regulatory Affairs. This position will track legislative and rulemaking activities and is responsible for legislative activity support and rulemaking coordination. This requires ongoing rulemaking analysis and implementation monitoring, as well as maintaining consistent communication through the unit supervisor with the DOR Executive Director’s Office, and the Governor's Office when appropriate.

Legislation & Rulemaking Coordination
  • Monitors legislative session for bill concepts and bills that are relevant to the Division and to the Department.
  • Completes the annual Regulatory Agenda and Review Report for the Executive Director's Office to send to the Department of Regulatory Agencies.
  • Evaluates proposed rule amendments from other state agencies and stakeholders, as well as internal proposals.
  • Maintains the rules calendar and file rules to ensure the MED is meeting statutory deadlines.
  • Drafts new rules and revised rules as needed.
  • Assist with the development of talking points for rulemaking work groups, rulemaking and legislative hearings, and other public meetings.
  • Monitors and maintains rule comment spreadsheets, both internal and external.
  • Monitors and maintains the MED legislative and fiscal note tracking spreadsheets.
  • Assist or leads in reviewing and advising on proposed legislation, including identifying potential rulemaking needs, fiscal impacts, appropriate and critical stakeholders to engage, and Division operational needs. This may include writing fiscal notes.
  • Assist with maintaining and updating the Division website as needed.
  • Coordinates rulemaking outreach, notifications, and publications, including leading the scheduling of and assisting with the facilitation of rulemaking or other stakeholder work group meetings and rulemaking hearings.
Policy Research & Analysis
  • May be required to work closely with other states' regulators, other Colorado state agencies, academics, or federal agencies to identify best practices in developing and implementing programs on any given topic.
  • Position leads and supports a wide variety of projects and tasks including research and analysis on relevant issues and report preparation for the Division as assigned or pursuant to statutory requirements.
  • Position assists with or lead managing and preparing for large scale stakeholder meetings, event planning, and assisting with presentation development.
  • Performs other, related duties, as assigned, including providing support for the Senior Policy Advisor - Social Equity and the Senior Policy Advisor - Local Affairs.
  • May also be required to work with local jurisdictions or local law enforcement.
Technical Assistance & Training
  • Drafts, reviews, and coordinates the issuance of formal Division communications, including position statements, industry bulletins, compliance tips, health & safety advisories, and rulemaking notifications. Participates in responding to formal inquiries submitted to the Division (known as "MED Inquiry").
  • Supports the coordination, development, and delivery of staff and stakeholder trainings on relevant legislative and regulatory updates.
  • Evaluates and identifies priorities related to technical assistance needs, establish, and develop technical assistance and training resources, and manage the successful implementation of technical assistance and training initiatives. This applies to both internal and external audiences.
  • Perform other related duties, as assigned.

Education and Experience:


OPTION 1:
  • 7 years of experience in a legal, `business, regulatory, or public policy/administration field.

OR

OPTION 2:
  • Bachelor's degree from an accredited institution in Public Administration, Public Policy, Legal Studies, Business Communications, Public Communications, Education, Government Administration, or a closely related field as determined by the Department.
  • Thee years of professional experience in a legal, business, regulatory, or public policy/administration field.

OR

OPTION 3:
  • Additional appropriate education in legal, business affairs, business, regulatory, or public policy/administration will substitute for the required experience on a year-for-year basis.

Substitutions:

Additional appropriate experience in public policy administration will substitute for the degree requirement on a year-for-year basis.
Preferred Qualifications:
The preferred candidate will possess the following qualifications:
  • Possess a law degree and have the demonstrated ability to perform legal research and prepare legal documents independently.

  • Proven ability to facilitate productive conversations.
  • The ability to work with a diverse group of stakeholders with competing interests.
  • Knowledge of home-rule municipality powers and limitations.
