Duties

Continually reviews and evaluates operations of field offices to determine their qualitative and quantitative adequacy and effectiveness in all respects, including: thoroughness and objectivity of investigations, prompt disposition of cases, effectiveness of efforts to obtain informal disposition of cases without recourse to formal action, sound and impartial preparation of cases for trial, effectiveness in conducting litigation and other proceedings before Administrative Law Judges, the Board and the courts, effectiveness of program to achieve voluntary compliance with Board Orders and court judgments, timely and accurate preparation of representation case decisions in accord with legal precedent, thoroughness and objectivity in conduct of representation hearings and elections, accurate interpretation and uniform application of Agency policy and objectives. To accomplish this, field office visits are conducted by each Assistant to the General Counsel.

Provides the central point in the Agency for the receipt, consideration and disposition of communications and materials to, from, or concerning field offices within the district. Provides solutions directly on problems presented and makes independent decisions on proposed actions wherever possible. Approves on behalf of the Associate General Counsel correspondence, instructions, and other communications to field offices. Serves as the frontline representative of the General Counsel for Agency level consideration and resolution of problems and inquiries presented by Members of Congress, Congressional Committees, the labor bar, and business and labor leaders at the highest level concerning any matters which relate to field operations within the District. Keeps thoroughly abreast of external labor management developments and conditions within the District through contacts with local and national representatives of both labor and management groups.

The Assistant to the General Counsel participates extensively in all aspects of case processing conducted by the field offices and by the headquarters units of the Office of the General Counsel. By virtue of this position, the incumbent is required to possess and maintain a commanding knowledge of both procedural and substantive law. Directly coordinates Regional Office case handling with the other Legal Divisions in both substantive and procedural matters. Is responsible for all aspects of the representation case pipeline, providing continuity and coordination of the issues and problems that will be encountered as a representation case is investigated, the handling of elections and any related pre- or post-hearing matter.

The incumbent participates with the Associate General Counsel and the Deputy Associate General Counsel in formulating General Counsel policy for the institution and administration of various Government-wide programs in the NLRB field organization, and monitor such, programs to insure their effective and uniform implementation at the regional level.

Incumbent shares responsibility for and assists the Associate General Counsel and the Deputy Associate General Counsel in the overall management of field office personnel, funds and services.

In addition, the Assistant to the General Counsel:

Performs a wide variety of regular and non-recurring assignments, many of a confidential nature, to assist the General Counsel in the discharge of administrative and substantive law responsibilities.

Upon assignment by the Associate General Counsel, formulates and develops long-range goals, objectives, and policy planning for the efficient operation of field offices and the effective administration of the Act.

On behalf of the Associate General Counsel, develops and supervises the implementation of national training programs, conferences and seminars for field office employees at all levels up to and including Regional Directors and for the attorneys of the headquarters case handling divisions of the Office of the General Counsel. In particular, the Assistant to theGeneral Counsel formulates nationwide training programs for administrative professionals, trial attorneys, hearing officers, investigators, supervisors, administrative staff, compliance experts and management officials.

Continuously reviews Agency policy and takes action to recommend revision of case handling and administrative manuals as necessary to reflect changes in policies and practices of the Agency and continuing developments in substantive law.

On special assignment from the General Counsel or the Associate General Counsel, supervises the preparation of analyses, reports and statements of position, or with respect to recommendations of study groups or task forces, bar associations or other groups, for issuance by the General Counsel.

Represents the General Counsel or Associate General Counsel in meetings with top level representatives of other agencies for the consideration of problems of mutual concern.
