Job Description
Summary

Presides over the Municipal Court at the direction of the Presiding Judge.

Essential Functions and Other Important Duties

Essential Functions:

  • Performs all functions and duties required under the City Charter, City ordinances, state law and other legally permissible and proper duties and functions as the position requires.
  • Serves as the Municipal Court Judge at the direction of and in the temporary absence of the Municipal Judge.
  • Reviews probable cause affidavits and complaints prior to issuance of warrants, and issues, as appropriate, warrants of arrest as to individuals or search warrants for persons or places within the jurisdiction.
  • While serving as the Municipal Judge, the Alternate Judge has all the powers and discharges all the duties of a Municipal Judge and supervises and controls the operation and clerical functions of the administrative department of the municipal court, including the court's personnel, during the proceedings or dockets of the court.
  • No guaranteed hours are provided with this position.
  • Serves as a Magistrate for both the City of Denton and Denton County with responsibilities including initial detention hearings of individuals in the custody of the Denton Police Department as required under Art. 15.17 of the Texas Code of Criminal Procedure though magistration of arrestees/ detainees, admonishment of rights and setting of appropriate bail, determination of probable cause, and issuing applicable conditions of bond.

Job Requirements

Minimum Qualifications/Acceptable Equivalency:

  • A licensed attorney with two or more years of experience in the practice of law in the State of Texas.
  • A resident of the State of Texas and a citizen of the United States.
  • A Member in good standing with the State Bar of Texas.
  • Availability to perform duties as a judge or magistrate at all times including after-hours warrant process and week-end and holiday jail related functions.
