Job Description

Summary

This position is in the Special Counsel and Labor Relations Office. The Special Counsel and Labor Relations Office provides legal advice and services on a centralized basis to the Chairman, the Board and General Counsel of the Agency and to all other officials and branches of the Agency.

The primary purpose of the position is to provide professional and expert legal services to the Agency.

Duties

This position is being advertised as both location negotiable after selection and with a duty station of Washington, DC with the option of telework. If applying to "negotiable after selection", this means that your duty station will be based off your home address and you will be a full-time remote worker. If applying to Washington, DC, you may be allowed to telework a set number of day(s) per pay period, with supervisory approval.

As a General Attorney (Labor & Employment) GS-0905-15, your typical work assignments may include:

  • Conducting legal research on variety of complex and sensitive labor, employment, and employee relations matters and must have familiarity with, and be able to research and apply to Federal sector cases, various other relevant employment statutes.
  • Advising and/or assisting the U.S. Department of Justice (DOJ), including U.S. Attorneys' Offices, in connection with federal employment litigation.
  • Representing the Agency in administrative and judicial adjudications and proceedings including before the Federal Labor Relations Authority (FLRA), the Merit Systems Protection Board (MSPB), Equal Employment Opportunity Commission (EEOC), and federal arbitrators.
  • Other duties as assigned.
  • Serving as the lead on the Agency's bargaining committees to include facilitation of discussions in the formulation of management proposals and position to take in bargaining, legal analysis of union proposals to determine negotiability, participate in and facilitate discussion in the preparation of counterproposals and participate in face-to-face bargaining sessions.
  • Drafting responses to grievances, particularly at the Step Three level, unfair labor practice position statements, and all other pleadings associated with administrative litigation including post-hearing briefs and Motions for summary judgment.
  • Conferring with the appropriate General Counsel-side or Board-side manager(s), and representatives of the Office of Human Resources concerning proposed adverse actions and conducts legal sufficiency review of these actions.
  • Serving as an expert on interpretation and application of statutes, case law, rules, and regulations and providing expert compliance advice to Agency clients on applicable authority.
  • Appearing on behalf of Agency management in settlement negotiations including in connection with EEOC ADR.

BAR MEMBERSHIP AND CERTIFICATION
Applicants must be an active member of the Bar in good standing of any state, District of Columbia, Puerto Rico, or any Territorial court under the US constitution. Your active BAR license must reference BAR number and indicate the status of good standing. An Agency's Self-Certification Form is not acceptable for verification.All qualifications and eligibility requirements must be met by the closing date of the announcement.

IDEAL CANDIDATE STATEMENT
The Ideal Candidate for the General Attorney (Labor and Employment) demonstrates extensive knowledge of and practice under the Federal Service Labor-Management Relations Statute. The candidate also demonstrates competence in managing projects and cases, as well as providing input on personnel matters and discussions. The Ideal Candidate is detailed, and task orientated and a problem-solver who takes pride in personal performance while delivering results along the way and inspiring staff to do the same.

BASIC REQUIREMENT
An applicant must have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (LL. B or JD).

In addition to the BASIC REQUIREMENT, applicants must also meet the following:

MINIMUM QUALIFICATIONS
To be qualify for this position, applicants must have one year of specialized experience equivalent to the GS-14 grade level, which has provided them with the knowledge, skills, and abilities to successfully perform the duties of a General Attorney (Labor and Employment) at the GS-15 grade level.

Specialized experience includes:Experience performing federal sector labor and employment litigation to include participation in EEOC, MSPB, and FLRA proceedings and handling discovery associated with these administrative proceedings; and
Experience conducting federal sector collective bargaining to include term and mid-term negotiations with federal agency unions; and
Experience providing authoritative guidance, interpretation and recommendations based on federal labor and employment statutes, rules, and regulations including Title V and OPM regulations; and
Experience providing federal employment law advice and training in areas of employee performance and conduct.

Education

An applicant must have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (J.D. or LL. B).

COVID-19 MANDATE
