Job Description
The City's Administration - Mayor/Council Department is now accepting applications for a Assistant Municipal Judge/Recorder. Under limited supervision, this position , performs judicial duties as the Assistant Municipal Court Judge for the municipal courts of the City. Acts in the interpretation, application and enforcement of local ordinances and applicable State laws. The Assistant Municipal Judge shall perform these duties by presiding over the municipal court sessions. Supervises the operation of the court in the absence of the Presiding Judge . Reports to Municipal Judge. ESSENTIAL JOB FUNCTIONS Presides over Municipal Court for City ordinances and code enforcement violations, criminal and traffic jury and nonjury trials, preliminary hearing, bond hearing and other cases appropriately tried in Municipal Court. Review and/or deny requests for continuances, dismissals, new trials. Determine innocence or culpability (when hearing cases without a jury) and levies fine commensurate with the violation in such manner to preserve equity and uniformity in the application of existing laws and ordinances. Supervise the administration of juror notification and direct jurors in trial cases on their role in the interpretation and application of law. Be available on a 24/7 basis, to review and/or sign summons, subpoenas, affidavits for search and arrest warrants, etc. Review legislation and current case law affecting offenses and the criminal justice system and implement procedures to ensure compliance. Perform legal research as needed and determine fine amounts. Issue warrants, summons, and search warrants. Collaborate with the City Administrator, City Council and applicable city departments to ensure policies, ordinances and orders are within the parameter of state law but also consistent with the values of the community and needs of the departments. Support the relationship between the City of Georgetown and the general public by demonstrating courteous and cooperative behavior when interacting with visitors and City staff; maintain confidentiality of work-related issues and City information. Perform other duties as required or assigned. ESSENTIAL SAFETY FUNCTIONS: It is the responsibility of each employee to comply with established policies, procedures and safe work practices. Each employee must follow safety training and instructions provided by their supervisor. Each employee must also properly wear and maintain all personal protective equipment required for their job. Finally, each employee must immediately report any unsafe work practices or unsafe conditions as well as any on-the-job injury or illnesses. ADDITIONAL JOB FUNCTIONS Serves as a member of various staff committees as assigned. Performs other related duties as required. MINIMUM TRAINING AND EXPERIENCE A valid license as an attorney, and a member in good standing of the State Bar of South Carolina; experience in the practice of law with two (2) or more years in the State of South Carolina; or an equivalent combination of education, training and experience that provides the required knowledge, skills and abilities. All municipal judges are required to complete a training program or pass certification or recertification examinations, or both, within one (1) year of taking office. Continuing Legal Education is required as set by the South Carolina Court Administration. MINIMUM QUALIFICATIONS OR STANDARDS REQUIRED TO PERFORM ESSENTIAL JOB FUNCTIONS Physical Requirements : Must be physically able to operate a variety of automated office machines and equipment. Must be able to exert up to 12 pounds of force occasionally and/or a negligible amount of force frequently or constantly to push, stoop, lift, pull, reach, kneel, climb, crouch, carry or otherwise move objects. Sedentary work involves sitting most of the time, but may involve walking or standing for periods of time. Must be able to lift/carry weights of up to 20 pounds occasionally.
