LIQUOR/TOBACCO ENFORCEMENT

Job Duties:
This position is located in the Liquor & Tobacco Enforcement Division and is a part of the Policy Team. This position assists the Policy Advisor IV and Policy Advisor III in preparing legal documents for the divisions, such as orders to show cause, denial notices, hearing notices, stipulations and agreements, and subpoenas. This position assists the Policy Advisor IV and Policy Advisor III in drafting and preparing for rulemaking. This position also maintains and updates the policy and procedure manual for LED at the direction of the Policy Advisor. The Legal Assistant will manage calendars, communicate with a variety of stakeholders using a variety of mediums, assist in preparing training documents to be utilized by the division.


Legislation, Rulemaking, and Policy

  • Performs mandatory applicant checks in Westlaw for new and renewal applicants.
  • Prepares documents for administrative violations.
  • Provides backup coverage for updates to web pages and web documents.
  • Prepares and produces all legal documents for use by the division, such as order to show cause, denial notice, hearing notices, stipulations and agreements, subpoenas, and other legal documents as required. Coordinates all hearings and prepare relevant documents for hearings.
  • Maintains and updates the policy and procedure manual for the division.
  • Ensures compliance with the State and Federal statutes and guidelines with respect to the information received from the CORA coordinator.
  • Assists in drafting rules and preparing for the rulemaking process.
  • Assists staff in drafting proposed actions for hearing considerations; and coordinates tracking of all division disciplinary actions.

Research
  • Assist the Appointing Authority and State Licensing Authority in researching statutes and rules pertaining to both the Liquor and Tobacco industries and the Colorado Criminal Code for clarification.
  • Attend division and industry meetings for legal research and to provide input.
  • Assist in the research of and enforce the compliance of the statutes and/or rules pertaining to discovery.
  • Research CORA requests and decide what information will be provided for a CORA request.

Minimum Qualifications, Substitutions, Conditions of Employment & Appeal Rights

MINIMUM QUALIFICATIONS:
Education and Experience:
A paralegal certificate obtained through either an American Bar Association approved paralegal studies program or an accredited college or university,
AND
One year of paralegal experience.

Substitutions:
Two years of work experience in a paralegal capacity which included conducting legal research, preparing drafts of legal documents, and gathering and compiling data from legal references and resources may substitute for the paralegal certificate.

A Juris Doctorate degree or equivalent from an accredited law school may be substituted for the paralegal certificate.

Necessary Special Requirements:
Applicants must possess a valid Colorado driver's license; must be willing and able to work nights, rotating shifts, weekends, and holidays; and must be willing and able to travel, both in and out of state, as required.

Preferred Qualifications:
The preferred candidate will possess the following:
  • Experience with Colorado Rules and Statues in regulatory environment.
  • Must be proficient in both Microsoft Word and Excel.
  • Excellent written and oral communication skills.
  • Have a law degree, and a license to practice law in the state of Colorado, and have the demonstrated ability to perform legal research and prepare legal documents independently.
  • Ability to work with a diverse group of stakeholders with competing interests.
  • Background and experience in liquor law, legislation and regulation.
  • Professional experiences with legislative processes, rulemaking, drafting of regulations or other relevant regulatory duties.
DOR Required Skills and Competencies :
Competencies required for all DOR positions include good communications skills, interpersonal and people management skills, the ability to multitask, the ability to work with confidential information, the ability to work in high-stress environments, and the demonstrated ability to assist customers.

Conditions of Employment with the Colorado Department of Revenue
:
1.As a condition of employment with the Colorado Department of Revenue, a requirement exists that all personnel timely file all necessary Colorado Individual Income Tax (CIIT) returns and timely pay tax obligations.
