Duties

The incumbent serves as the Deputy Associate General Counsel, participating with the Associate General Counsel in managing the operations and responsibilities of the Administrative Law Division, and providing expert guidance on diverse legal matters and issues affecting the policymaking, rulemaking, and adjudicatory functions of the agency. He/she also supervises the Division's experts on communications law, constitutional law, and administrative law. He/she reports to the Associate General Counsel, Administrative Law Division.

This position offers a unique opportunity to advise on a wide range of legal issues that critically affect the work of the Federal Communications Commission, to support and shape policies, and to offer creative solutions to thorny legal and procedural issues affecting the Commission’s strategic goals, which include pursuing a “100 percent” broadband policy and eliminating the “digital divide”; promoting deployment of communications services and equipment (including broadcast, wireless, wireline, and satellite services) and competition within and among such services; diversity, equity, inclusion and accessibility; empowering consumers and protecting them from unlawful practices by communications providers and robocallers; enhancing public safety, national security, cybersecurity, and privacy in the use of communications services and equipment; advancing America’s global competitiveness; and fostering operational excellence. He/she reports to the Associate General Counsel, Administrative Law Division. The position requires substantial experience in addressing the administrative and constitutional law issues raised by the Supreme Court and the courts of appeals in decisions involving judicial review of actions by federal administrative agencies, as informed by the most recent trends in these decisions.

Participates as a subject matter expert rendering authoritative legal advice and opinions on a wide range of extremely complex and difficult communications law, constitutional law, and administrative law and policy issues, applying Federal and state statutes and regulations, policy statements, court cases, and actions falling within these and other areas of the law to provide well-reasoned and legally sufficient advice to the General Counsel and agency leadership. Reviews and analyzes the trend of administrative law to determine its effect and/or potential impact upon the Commission’s mission, functions, programs and activities.

Oversees and advises Division attorneys who provide legal advice to all of the Commission Bureaus and Offices and to the Chairman and Commissioners regarding proposed agency policy initiatives and proceedings. Those attorneys also review for legal sufficiency all draft Commission decisions. Incumbent reviews the substantive legal analysis and advice provided by these teams in the subject matter areas of wireline, wireless, media, international, space, public safety and homeland security, engineering and technology, enforcement, and consumer and governmental affairs.

Reviews and drafts regulatory and legislative initiatives as directed by the Associate General Counsel; prepares opinions, recommendations, and legal memoranda; and represents the Associate General Counsel, the General Counsel, or other agency leadership at meetings, hearings, and conferences.

The incumbent coordinates with the Associate General Counsel, the Deputy General Counsel, and the General Counsel in determining final advice provided regarding the most complex, novel, and/or difficult legal issues.

In consultation with Associate General Counsel, incumbent plans overall work operations, setting priorities and establishing objectives. The incumbent assigns work to subordinates based on priorities, selective consideration of the difficulty and requirements of the assignment, and the capabilities or specialized expertise of employees.

The incumbent develops work and objectives, monitors performance, and evaluates completed work in a formal appraisal. The incumbent interviews candidates for positions and makes recommendations for appointment, promotion or reassignment.

Qualifications

Applicants must meet eligibility and qualification requirements by the closing date of this announcement. Current Federal employees must meet time-in-grade requirements by the closing date of this announcement.

Specialized Experience: Specialized Experience is experience which is in or directly related to the line of work of the position to be filled and which has equipped the applicant with the knowledge, skills, and abilities to successfully perform the duties of the position. Applicants must have a minimum of one year of specialized experience in or equivalent to the next lower grade level in the Federal Service.

Professional law experience is experience that has equipped the applicant with the particular knowledge, skills, and abilities to perform successfully the duties of the position and is typically in or related to the work of the position to be filled.

In order to be deemed as "BEST QUALIFIED" candidates must meet both the educational requirements AND the Specialized Experience.

A. Education

You must meet the minimum basic educational requirements for Attorney positions. Education requirements include: a professional law degree JD, LL.B., and/or LL.M.

B. Specialized Experience

To Qualify at the GS-15 level: Applicants must possess at least four years of professional law experience and at least one year of specialized experience must be equivalent to at least the GS-14 in the Federal service. For this position, specialized experience includes the following:

1. Interpreting statutes, regulations, and rulemaking documents; 2. Interpreting and applying one or more of the following areas of law: communications law, administrative procedure, constitutional law, fiscal law, administrative and privacy law, ethics, contracts, torts, fraud, labor relations, environmental law, real estate and conflicts of interests law and other administrative law statutes; 3. Interpreting and applying the Communications Act and FCC regulations; 4. Preparing comprehensive legal documents; 5. Analyzing complex legal issues; and 6. Supervising or managing subordinate staff.

PART-TIME OR UNPAID EXPERIENCE: Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community, student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience.
