Overview
  • Responsible for providing legal advice to assigned business units and/or markets providing comprehensive, end-to-end legal support by facilitating thoughtful risk-taking to enable Mastercard to deliver on strategy.

  • The ideal candidate will have the ability to think and act both strategically and tactically with respect to the needs of business clients and their objectives while ensuring that Mastercard C&I products remain compliant with privacy and data-related laws.
  • The position will report to the Senior Managing Counsel, Privacy & Data Protection, Cyber & Intelligence Solutions. It will be a member of the Global Mastercard Privacy & Data Protection team.
  • The Senior Counsel must be abreast of technologies related to fraud and identity.
  • The Senior Counsel will lead the enhancement of Ekata’s privacy program while collaborating closely with Mastercard product teams to ensure compliance of identity products with existing and emerging privacy and data-related laws applicable to fraud and identity.

Role:
  • Support development of products and solutions fully align with Mastercard’s privacy and data protection policies and procedures and perform Data Protection Impact Assessments in line with Mastercard’s Privacy by Design process.
  • Provide day-to-day privacy advice to the C&I product and sales teams and partner with business clients to develop C&I products in compliance with global privacy & data-related laws applicable to fraud and identity.
  • Develop contract structures that address data usage as well as privacy and data protection requirements and lead the review and negotiation of applicable privacy and data protection language in agreements with customers and vendors
  • Provide regular trainings and updates about privacy, fraud and identity to the global privacy, legal, business and sales teams to ensure compliance with emerging laws and regulations.
  • Monitor regulatory and legislative developments pertaining to fraud and identity verification and support the engagement with key policy makers and stakeholders to influence developments in that space.

All About You:
  • Experience in drafting and negotiating complex data processing terms
  • Superior time management, planning, and organizational skills
  • Strong analytic capabilities, and written and oral communication skills. Attention to detail is a must.
  • Solid knowledge of the GDPR and global data protection legal frameworks (e.g. CPRA, FCRA)
  • Familiarity with financial services industry, fraud prevention and payment processing
  • Exceptional interpersonal skills with proven experience in relationship building and partnering at various (organizational) levels internally and externally. Must work well in both team and individual settings
  • Ability to motivate and influence highly skilled professionals to achieve major organizational goals
  • Solid expertise in and track record dealing with privacy and data protection law in multi-jurisdictional settings
  • Law degree required. Membership to a Bar (if permitted by law). Any additional qualifications (e.g. Master of Laws degree, IAPP Certifications) considered an asset
