General Summary:

This position is responsible for managing surplus property and disposition activity, reviewing and negotiating condemnations, easements, etc., resolving triple net property default litigation, enforcing Landlord rebuild obligations for Disaster closures, and negotiating short-term lease extensions, facility upgrades, co-tenancy waivers and common area upgrades. This individual must utilize independent, critical thinking, problem-solving and analytical skills to negotiate lease modification agreements, analyze property details, such as Legal Description, Site Plan, boundaries, etc., perform in-depth lease research, and apply practical real estate knowledge in making appropriate decisions and enforcing lease provisions.

Duties and Repsonsiblities:

§ Manage all activities related to surplus property management and disposition, including oversight of surplus disposition and property management vendors, evaluation of early terminations, subtenant proposals and/or sale offers related to company owned properties. Responsibilities include financial analysis, risk mitigation, legal review, and buyer/subtenant qualification. For vacant properties, procures and approves bids for property repairs, maintenance and inspection services. For subleased properties, serves as the liaison between subtenant and DG, ensuring sublease compliance with respect to repair and maintenance obligations, rent payment and reimbursable expenses.


§ Manage right-of-way, condemnations, easements, lease restrictions, co-tenancy waivers, parcel splits, common area alterations, building improvements, etc. as requested by government authorizes, landlords, etc. Assess lease/legal implications of request and partner with field Ops to understand impact on business operations. Conduct independent negotiations with the Landlord, Property Manager or Landlord’s attorney and perform a financial metrics analysis for each project. Secure appropriate exhibits to memorialize negotiated changes, and present recommendation to Sr. Manager, Property Management & Compliance and Vice President, Lease Administration.


§ Resolve (prevent) litigation involving Tenant (DG) default for triple net properties by researching and interpreting lease obligations, determine the appropriate corrective measures and partner with internal departments (Real Estate Legal, Risk Mgmt., Store Facilities, Field Ops, etc.) to initiate plan of action and ensure compliance of the lease. Communicate with Landlords and/or their attorneys regarding the plan of action and/or disputes claim.


§ Support company initiatives and special projects, including property acquisitions, Disaster closed stores, technology development, and merchandising/remodel initiatives. For projects requiring Landlord involvement or consent, negotiate scopes of work for facility upgrades, Disaster rebuilds, property improvements, use waivers, stockroom expansions, etc.


§ Develop and manage reports to communicate on-going activities to senior management, seeking direction on site-specific issues as necessary. Draft and negotiate highly structured lease language and create legal documents (as necessary) in accordance with the Lease and Law Department established guidelines, securing assistance from in-house counsel as needed.

Qualifications:
Paralegal, Business Management degree (or related field) or demonstrable equivalent experience.
At least five (5) years’ experience in Facilities Management, Legal, or Lease Administration fields preferably in a retail environment.
